Terms of Service

Welcome to Lynup, a service operated by Swartz Group LLC, a California limited liability company ("Swartz Group", "we", "us", or "our"). Lynup is a DBA (doing business as) of Swartz Group LLC. By creating an account or using the service you agree to these Terms of Service. Please read them carefully.
1. Beta Service
Lynup is currently in beta. This means the service is provided for testing and feedback purposes and may contain bugs, experience downtime, or change significantly. We may modify or discontinue features, and in rare cases reset data, with reasonable notice. Use during beta is at your own risk.
2. Eligibility
You must be at least 18 years old to use Lynup. By creating an account you confirm that you meet this requirement. If we discover an account belonging to someone under 18 we will terminate it.
3. Your Account
You are responsible for keeping your login credentials secure and for all activity under your account. Notify us immediately at hello@lynup-music.com if you suspect unauthorised access.
4. Acceptable Use
You agree not to:
- Post content that is illegal, harassing, defamatory, or infringes the rights of others.
- Impersonate another person or misrepresent your identity.
- Scrape, crawl, or systematically collect data from the service.
- Attempt to gain unauthorised access to any part of the service or its infrastructure.
- Use the service to send spam or unsolicited commercial messages.
- Interfere with the proper functioning of the service.
5. Your Content
You own the content you post on Lynup (profile information, comments, venue suggestions, etc.). By posting it, you grant Lynup a non-exclusive, worldwide, royalty-free licence to display and distribute that content as part of operating the service. We will not sell your content to third parties.
You are solely responsible for the content you post. Do not post anything you do not have the right to share.
6. Intellectual Property
The Lynup name, logo, and all original software and design are owned by Swartz Group LLC. Nothing in these Terms transfers any of those rights to you.
7. Termination
We may suspend or terminate your account at any time for violations of these Terms or behaviour we determine to be harmful to the community or the service. You may delete your account at any time by contacting us.
8. Disclaimers
The service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the service will be uninterrupted, error-free, or that any particular feature will remain available. Event information shown in the app is sourced from third parties and may be inaccurate — always verify directly with the venue.
9. Limitation of Liability
To the fullest extent permitted by law, Lynup and Swartz Group LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, even if advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the greater of $10 or the amount you paid us in the twelve months preceding the claim (which during beta is $0).
10. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of San Francisco County, California.
11. Changes to These Terms
We may update these Terms from time to time. We'll notify registered users by email of material changes. Continued use after changes take effect constitutes acceptance.
